Lawsuit Filed Regarding Sinkhole Damage

Sinkhole damage is sometimes easy to detect - as in the case where there is catastrophic ground cover collapse.  But, in most cases, the first notice of a sinkhole is simply the damage that begins to materialize at your home or building.

Such was the case for a new client of mine.  When his floors and walls began cracking, he suspected sinkhole.  He called his insurance company which denied the claim.  As frequently occurs, the insurance company attributed the cracking to settling, improper compaction, and high organic content in the soil. 

We've filed suit seeking recovery for the damages caused by the sinkhole, including subsurface sinkhole remediation, and repair to the home itself.

The telltale signs of sinkhole can be seen in the photos of my client's home below.

The type of sinkhole causing the damage to this house is known as a "subsidence sinkhole."  This type of sinkhole as well as the catastrophic ground cover collapse sinkhole are both covered under all Florida homeowners insurance policies. 

In a case such as this, I front all costs for investigating the sinkhole and prosecuting the case.  And, if we win, in many cases, the insurance company must pay my fees and costs.  If we lose, I'll work for free.
